The Cabinet of Ministers issued a resolution approving a regulation on the procedure for providing outstaffing services. The Regulation on procedure for providing outstaffing services has defined the following:

  • types of work that cannot be performed under contracts for provision of outstaffing services;
  • procedure and conditions for entering into a contract;
  • provisions of labor relations with employees sent by outstaffer under contract.

Outstaffing services shall be provided on the basis of a contract entered into between the employer and another legal entity. According to the contract on the provision of outstaffing services, employees perform labor functions in the interests of the legal entity sent by the employer, under its management and control. Payment of wages for the work of employees is carried out by the employer.

Legal entities registered in the territory of Uzbekistan have the right to provide outstaffing services. It is not allowed to provide outstaffing services due to sending of employer's employees to perform labor duties outside the country.

The types of work that are not allowed to be performed under contracts for the provision of outstaffing services include:

  • in accordance with regulatory documents, performing work on high-risk objects (equipment), including explosion and fire, aggressive or radioactive equipment;
  • cases where the host organization is undergoing insolvency procedures, there is a risk of mass layoffs, overtime work to save jobs, etc.
