The Uchtepa Civil Court ordered to pay 300 million soums in indemnity from the state budget to illegally convicted businessman Dilshod Mingboev, who spent five years in prison.

The case was heard by Judge Lola Utanboeva. Dilshod Mingboev, 42, headed Sadaf LLC when he was convicted in 2011 under the Violation of customs legislation charge of the Criminal Code and was sentenced to eight years in prison.

After five years in prison, he was acquitted and released. He filed a claim in civil court for indemnity of 1 billion soums.

"During the five years I spent in prison, we experienced a lot of hardships. It was very difficult for my mother; she got ill because of it. My wife, my mother, and I have been through so much," Mingboev said in court.

"On November 28, 2020, the Supreme Court's supervisory authority fully acquitted my client of the most serious charges under which he had bee unjustly imprisoned. The court upheld Official negligence charge. Correctional labor was imposed under this article, and then the criminal case was dismissed under an amnesty. The Supreme Court's ruling proved that Dilshod Mingboev spent five years in prison without justification," said the lawyer Fayzinisa Atayeva.

The court awarded 300 million soums in indemnity for the unlawful sentence. This money shall be paid from the territorial target fund for indemnity of property damage to individuals and legal entities under the Tashkent province governor’s office.

Following the hearing, Dilshod Mingboev said he was satisfied with the court's ruling.

Judge Lola Utanboeva noted in an interview with the television channel that judges, like doctors, have no margin for error. She added that estimating moral damages in monetary terms was extremely difficult because it was impossible to estimate the trials and tribulations of the individual and their family during the five years they spent in prison.

Last January, a former law enforcement officer, convicted of criminal inaction 13 years earlier, was acquitted. The man explained that, even after serving his sentence, he had been unable to find work due to his criminal record.
