The next congress of the Chamber of Commerce and Industry On took place on June 16. The congress was attended by the Minister of Justice Ruslanbek Davletov, who spoke about the Business Code, about the analysis of problems in the business-related regulations, and their solution.
According to the Ministry of Justice, the minister focused on two main issues in his remarks.
“Everyone should understand one thing, the main essence of any business is to make profit, efficiency and investing the income. That is, the more profit a business gets, the more he will invest, and this will contribute to the economic growth. This means that the state is interested in the development of buisness,” Ruslanbek Davletov said.
He noted that the Ministry of Justice is developing a draft Business Code, which will become the only legal source for entrepreneurs. The project is being developed on the basis of the principles of “One in two out”, BPR, which are modern methods of lawmaking in accordance with the concept of smart regulation.
What is the code for?
Firstly, now the business-related regulations have been adopted separately, and there are a lot of them. In particular, there are about 5000 legal acts related to businss.
An excessive number of documents can cause collisions between them. Naturally, difficulties arise in finding the necessary document and applying them in practice, and this entails claims of business entities.
The minister added: “A buisnessman must work and implement his ideas. If he does only paperwork, who will do business? Therefore, he should have in his hands a compact and understandable set of legal norms. For example, in Japan, a businessman has only the Commercial Code, and he is guided by it. "
Secondly, with the legal regulation, there is a need to eliminate loopholes, based on modern trends, the issue of complete regulation of new social relations from a legal point of view. For example, the criteria for "medium business", innovative entrepreneurship and e-commerce (enterprises - startups, innovation clusters, technology parks, etc.).
He underscored that the adoption of the BUsiness Code will serve to unify acts of legislation adopted absent-mindedly and with various conflicts into a single document, stabilize the business-related regulations, reduce state interference, as well as determine a unified approach.
He reported that the draft would be presented for public discussion in September-October.
