On March 28, the Ministry of Justice registered amendments to the internal control rules for combating the legalization of criminal proceeds. The amendments were developed by the Central Bank and the Department for Combating Economic Crimes of the Attorney General's Office.

According to the new requirements, payment systems will be required to take independent steps to properly verify clients in a number of cases.

In particular, verification shall become mandatory:

  • when an individual applies to open an account through a payment organization's mobile app;
  • when suppliers of goods and services apply to receive an electronic terminal (E-POS);
  • when sending and receiving transfers in the amount of 30 BCU and above (from 11.25 million soums);
  • when conducting transactions in the amount of 500 BCU (187.5 million soums) without opening an account or without using an account in a mobile app.

If the amount of the internal transfer is 30 BCU or more, the payment service must provide the following data:

  • for individuals — the sender's name, series and number of the identity document (international passport, ID card or other equivalent document), and if an account was used for the transaction — its number or unique transaction number;
  • sender's address or their Tax code or customer identification number;
  • for individuals — also the date and place of birth;
  • information about the recipient (their name, as well as the account number or unique transaction number, if an account was used for the transaction).

An exception is when the recipient's bank can obtain full information about the sender from other sources. In this case, the payment organization only needs to attach the personal identification number of an individual (PINI), as well as the account number or transaction identifier, provided that they allow tracking the transaction from the sender to the recipient.

For transfers of up to 30 BCU, it is sufficient to indicate the name for legal entities, and for individuals — the full names of the sender and recipient. If an account is used for the transaction, the account number must also be specified.

Payment system operators, electronic money system operators and payment organizations must determine the degree of accuracy between the data obtained during the identification of the client and the information from the lists of persons suspected of financing illegal activities.

The degree of accuracy must be established separately for each element of the identification data of the transaction participants.
