Uzbekistan has introduced a mandatory screening process for former public servants seeking employment at organizations previously under their regulatory control, the Ministry of Justice said.
The new rule stems from the Conflict of Interest Law. Under the regulation, if an individual applies to work at such an organization within two years of leaving their government post, the prospective employer must obtain clearance from the anti-corruption unit at the candidate's former workplace. The hiring company's HR department is required to submit this request within one business day of intending to hire the applicant.
Based on the review, the anti-corruption unit will issue one of three rulings:
- Approved: The applicant can be hired without restrictions.
- Approved with restrictions: The applicant can be hired, provided specific conditions are met.
- Rejected: The application for employment must be rejected.
Employers are strictly prohibited from hiring a former public servant without this official clearance or if the request is denied.
If employment is approved with restrictions, the new hire is barred for three months from participating in any decisions involving their former regulatory target. Additionally, their job responsibilities must be reassigned to completely eliminate any conflict of interest, and their work will be closely monitored by the organization's internal anti-corruption unit.
Former public servants have the right to appeal any unfavorable decisions through a higher governing body or the Anti-Corruption Agency.
