The Yashnabad district criminal court of Tashkent on July 11 sentenced the Nexia driver, who in January 2023 hit a pregnant woman who later died in hospital.
According to the criminal case findings, on January 3, at approximately 18:50, the driver of the Nexia-3 sedan (name and surname hidden in the text of the verdict), ignoring road and weather conditions, as well as limited visibility, hit a female pedestrian, S.M., who was 37 weeks pregnant, the court ruling says.
As a result, the victim was taken to the hospital with serious injuries, and died the next day (January 4) from her injuries. Before her death, she gave birth to a child, but after some time the boy also died.
The forensic medical examination concluded, the death of the woman and baby occurred as a result of a closed craniocerebral injury and hemorrhage in the brain. It was established that both died due to an accident.
The driver's guilt was also proven by reports from the accident scene and expert opinions.
In his testimony, the defendant stated that the woman was crossing the road at an unregulated pedestrian crossing in front of the Yangiabad shopping complex. According to him, he was driving at a speed of 60-65 km/h and did not see how she passed across the road on the right side “due to heavy rain and the absence of cars in the right and left lanes ahead.” The driver put the victim on a passing Damas and took her to the hospital.
The driver stated that he covered all financial damage to the injured party and asked the court to impose a lighter sentence.
The mother of the deceased stated that her son-in-law and son were abroad, so they are absent from the trial. She noted that she had no claims against the defendant and asked the court to impose a sentence that did not involve imprisonment.
Judge Anvar Ikromov found the defendant guilty under Violation of traffic safety rules or operation of vehicles, resulting in human casualties / punishable by up to 10 years of imprisonment with deprivation of certain rights charge and sentenced him to 5 years of imprisonment with deprivation of the right to drive vehicles for three years.
At the same time, the court applied Suspended sentence charge and replaced the sentence with a suspended sentence with a probationary period of three years.
When mitigating the sentence, the court took into account the driver’s admission of guilt, his young age (the specific age, like his name, is hidden), family conditions, lack of criminal record, positive characteristics from the Damarik mahalla, and the fact that he is the only breadwinner in the family. His representative was also returned 10 million soums, which were paid as collateral.
