Tashkent appellate court ruled to release the driver of a Kia Stinger, who hit a pedestrian in the Sergeli district of Tashkent in the spring. On May 9, at about 17:00, at the territory of the Avtotuning.uz car service (not far from the airport), 24-year-old driver A. Kh. hit 27-year-old owner of the Instagram page avtotuning_uz D. K., who died from his injuries on the way to the hospital.

Footages that appeared on social networks showed that the drivers of two cars were racing and one of them hit a person who had stepped onto the roadway.

A criminal case was launched under the Violation of traffic safety rules resulting in the death of a person charge (punishable by imprisonment for up to 7 years with deprivation of a certain right).

On August 14, the Sergeli district criminal court sentenced the man, an employee of the Avtotuning.uz car service, to 3 years of imprisonment with a 2-year ban on driving.

The court ruling underscored that the driver, driving at 60-70 km/h, violated a number of traffic rules and hit a pedestrian.

According to the forensic medical examination, the deceased received a combined injury, an open craniocerebral injury, fractures of the vault and base of the skull with the formation of fragments, a contusion of the brain, hemorrhages under the membrane and in the brain tissue, closed blunt injuries to the chest and abdomen, closed fractures of the left clavicle and bilateral rib fractures, a contusion and rupture of the lungs, a contusion and rupture of the loop of the small intestine, open fractures of the middle-lower third of the right tibia, closed fractures of the lower third of the left tibia, lacerated and contused wounds of the head, the back of the chest and other injuries.

The defendant's lawyer filed an appeal. In it, he stated that the court of first instance did not take into account the absence of claims from the representative of the deceased, as well as the admission of guilt and repentance on the part of the accused, who had no previous convictions and is the sole breadwinner in the family, and imposed a severe punishment.

Deputy chief of Tashkent Prosecutor's Office M. Komilov requested the court not to satisfy the complaint.

However, the panel of judges of the Tashkent city criminal court, chaired by Judge Muzaffar Akhmedov, decided at a session on September 12 to deduct 4 months and 2 days of detention from the sentence and replace the remaining 2 years, 7 months and 28 days of imprisonment with a suspended sentence with a probationary period of 2 years.

The defendant is prohibited from leaving the territory of Uzbekistan without permission from the supervisory authority and is required to notify about a change of residence or study, as well as to register with the internal affairs agencies.

The preventive measure in the form of arrest was canceled, and he was released from the courtroom.
