In November 2024, a man who intended to have a sexual intercourse with a 13-year-old neighbor's daughter in Andijan province was only handed five-day administrative arrest for this, the anti-violence Nemolchi.uz project said.
According to the court’s case and his own testimony, Bakhodir Artykov, 37, was unable to satisfy his wife's intimate needs and told her to bring his neighbor M. to him. However, according to him, he then fell asleep and does not remember what happened next.
Minor M. testified in court that on that day the neighbor brought her to her home and told her to have a sexual intercourse with her husband. The woman added that she would blindfold her so that the teen "would not see anything and would not feel pain," and offered 50 thousand soums for this. The girl refused, then Artykov intervened in the conversation, saying that if she agreed, he would pay 100 thousand soums. The girl got scared and ran away.
The mother of the minor told the court that her daughters M. and R. called her and said that M. was brought to the neighbors' house so that Artykov could satisfy his sexual desire. She added that there was no physical injury or violence, but asked to satisfy the complaint: in her opinion, the actions of Artykov and his wife may contain elements of a criminal offense. Therefore, the mother asked to overturn the decision of the court of first instance and send the case to the prosecutor's office.
The court of first instance, chaired by Judge Azizbek Begmatov, found that the actions of Bakhodir Artykov and his wife were correctly classified under Sexual harassment charge of the Administrative Responsibility Code.
The Court of Appeal, chaired by Judge Nodirbek Mirzadzhonov, refused to satisfy the complaint of the girl's mother and also did not agree with the statement on the need to initiate a criminal case, leaving the decision to bring to administrative responsibility unchanged. Artykov was sentenced to administrative arrest for 5 days, and his wife was fined 750 thousand soums.
Attempts to engage in sexual intercourse with minors, including for money, are regulated only by the Criminal Code. Any sex with children under 14 is a particularly serious crime, which is considered immediately under Rape charge of the Criminal code. It does not matter whether the child was forced to do it, whether violence was used or not. If the intention for some reason did not succeed, then a criminal case is usually initiated under Article 25 of the Criminal Code "Preparation for a crime and attempted crime". There is also Chapter VII of the Criminal Code on complicity in a crime. And there is Article 131 of the Criminal Code for pimping".
